This paper explores early Australasian philosophy in some detail. Two approaches have dominated Western philosophy in Australia: idealism and materialism. Idealism was prevalent between the 1880s and the 1930s, but dissipated thereafter. Idealism in Australia often reflected Kantian themes, but it also reflected the revival of interest in Hegel through the work of ‘absolute idealists’ such as T. H. Green, F. H. Bradley, and Henry Jones. A number of the early New Zealand philosophers were also educated in the idealist tradition (...) and were influential in their communities, but produced relatively little. In Australia, materialism gained prominence through the work of John Anderson, who arrived in Australia in 1927, and continues to be influential. John Anderson had been a student of Henry Jones, who might therefore be said to have influenced both main strands of Australian philosophical thought. (shrink)

Gustav Radbruch war Deutschlands beruhmtester Rechtsphilosoph im 20. Jahrhundert. Seine gehaltvollen, aber auch spannungsreichen Schriften pragen die deutschsprachige Rechtsphilosophie bis heute. Im Zentrum von Radbruchs Lehre steht sein neukantianisch gepragter Rechtsbegriff, der im Laufe der Zeit eine Reihe von Veranderungen erfahren hat. Die Beitrage in diesem Band sind Radbruchs Rechtsbegriff im Allgemeinen und den Wandlungen dieses Rechtsbregriffs im Besonderen gewidmet. Nach der orthodoxen Lesart vertrat Radbruch vor dem Kriege eine rechtspositivistische Lehre, wurde unter dem Eindruck der nationalsozialistischen Grauel jedoch zum (...) Naturrecht bekehrt. Zunehmend wird gesehen, dass diese 'Bekehrungsthese' zu Ungereimtheiten fuhrt. Verschiedene Beitrage dieses Bandes betonen demgegenuber die Kontinuitat nichtpositivistischer Elemente in der Entwicklung von Radbruchs Rechtsbegriff. In recent years, cognitive neuroscientists have began to explore the process of how sensory information gains access to awareness. To further probe this process, event-related functional magnetic resonance imaging was used while testing subjects with a paradigm known as the “attentional blink.” In this paradigm, visually presented information sporadically fails to reach awareness. It was found that the magnitude and time course of activation within the anterior cingulate , medial prefrontal cortex , and frontopolar cortex predicted whether or not information (...) was consciously perceived during the critical period for the attentional blink. These results are discussed in light of a neural framework for conscious processing. (shrink)

In 1856, the State of Ohio began an enumeration of its population to count and identify people with disabilities. This paper examines the ethical role of the accounting profession in this project, which supported the transatlantic eugenics movement and its genocidal attempts to eliminate disabled persons from the population. We use a theoretical approach based on Levinas who argued that the self is generated through engagement with the Other, and that this engagement presupposes a responsibility to and for the Other. We show that successive waves of legislation relied on State and County auditors along with Township clerks and assessors to conduct the mechanics of the enumeration of the population, which focused on the identification, categorization, and counting of the disabled people of the State. We argue that the accounting-based technologies of enumeration and reporting objectify the enumerated persons and deny the auditor’s pre-existing ethical obligation to this new Other. We show how the financial expertise and structures of the State were engaged in the execution of this mandate, which remained in place for over a century and supported a program of institutionalization. We consider the ramifications of this for our understanding of the ethical role of public sector accounting in the United States over this period, which has been under-explored. (shrink)

The shortage of organs for transplantation by its nature prompts ethical dilemmas. For example, although there is an imperative to save human life and reduce suffering by maximising the supply of vital organs, there is an equally important obligation to ensure that the process by which we increase the supply respects the rights of all stakeholders. In a relatively unexamined practice in the USA, organs are procured from unrepresented decedents without their express consent. Unrepresented decedents have no known healthcare wishes (...) or advance care planning document; they also lack a surrogate. The Revised Uniform Anatomical Gift Act of 2006 sends a mixed message about the procurement of organs from this patient population and there are hospitals that authorise donation. In addition, in adopting the RUAGA, some states included provisions that clearly allow organ procurement from unrepresented decedents. An important unanswered question is whether this practice meets the canons of ethical permissibility. The current Brief Report presents two principled approaches to the topic as a way of highlighting some of the complexities involved. Concluding remarks offer suggestions for future research and discussion. (shrink)

Records of online collaborative mathematical activity provide us with a novel, rich, searchable, accessible and sizeable source of data for empirical investigations into mathematical practice. In this paper we discuss how the resources of crowdsourced mathematics can be used to help formulate and answer questions about mathematical practice, and what their limitations might be. We describe quantitative approaches to studying crowdsourced mathematics, reviewing work from cognitive history (comparing individual and collaborative proofs); social psychology (on the prospects for a measure of (...) collective intelligence); human–computer interaction (on the factors that led to the success of one such project); network analysis (on the differences between collaborations on open research problems and known-but-hard problems); and argumentation theory (on modelling the argument structures of online collaborations). We also give an overview of qualitative approaches, reviewing work from empirical philosophy (on explanation in crowdsourced mathematics); sociology of scientific knowledge (on conventions and conversations in online mathematics); and ethnography (on contrasting conceptions of collaboration). We suggest how these diverse methods can be applied to crowdsourced mathematics and when each might be appropriate. (shrink)

Psychiatric disorders present distinct clinical challenges which are partly attributable to their multifactorial aetiology and the absence of laboratory tests that can be used to confirm diagnosis or predict risk. Psychiatric disorders are highly heritable, but also polygenic, with genetic risk conferred by interactions between thousands of variants of small effect that can be summarized in a polygenic risk score. We discuss four areas in which the use of polygenic risk scores in psychiatric research and clinical contexts could have ethical (...) implications. First, there is concern that clinical use of polygenic risk scores may exacerbate existing health inequities. Second, research findings regarding polygenic risk could be misinterpreted in stigmatising or discriminatory ways. Third, there are concerns associated with testing minors as well as eugenics concerns elicited by prenatal polygenic risk testing. Fourth, potential challenges that could arise with the feedback and interpretation of high polygenic risk for a psychiatric disorder would require consideration. While there would be extensive overlap with the challenges of feeding back genetic findings in general, the potential clinical use of polygenic risk scoring warrants discussion in its own right, given the recency of this possibility. To this end, we discuss how lay interpretations of risk and genetic information could intersect. Consideration of these factors would be necessary for ensuring effective and constructive communication and interpretation of polygenic risk information which, in turn, could have implications for the uptake of any therapeutic recommendations. Recent advances in polygenic risk scoring have major implications for its clinical potential, however, care should be taken to ensure that communication of polygenic risk does not feed into problematic assumptions regarding mental disorders or support reductive interpretations. The dorsal anterior cingulate cortex is a key node in the human salience network. It has been ascribed motor, pain-processing and affective functions. However, the dynamics of information flow in this complex region and how it responds to inputs remain unclear and are difficult to study using non-invasive electrophysiology. The area is targeted by neurosurgery to treat neuropathic pain. During deep brain stimulation surgery, we recorded local field potentials from this region in humans during a decision-making task requiring motor output. (...) We investigated the spatial and temporal distribution of information flow within the dACC. We demonstrate the existence of a distributed network within the anterior cingulate cortex where discrete nodes demonstrate directed communication following inputs. We show that this network anticipates and responds to the valence of feedback to actions. We further show that these network dynamics adapt following learning. Our results provide evidence for the integration of learning and the response to feedback in a key cognitive region. (shrink)

The vice of liberalism is not selfishness so much (...) as a forgetfulness that spreads like a blight from the habit of abstraction. Ever since Kant and Hegel, the notion of autonomy—the idea that we are beholden to no law except one we impose upon ourselves—has been considered the truest philosophical expression of human freedom. But could our commitment to autonomy, as Theodor Adorno asked, be related to the extreme evils that we have witnessed in modernity? In Autonomy after Auschwitz, Martin Shuster explores this difficult question with astonishing theoretical acumen, examining the precise ways autonomy can lead us down a path of (...) evil and how it might be prevented from doing so. Shuster uncovers dangers in the notion of autonomy as it was originally conceived by Kant. Putting Adorno into dialogue with a range of European philosophers, notably Kant, Hegel, Horkheimer, and Habermas—as well as with a variety of contemporary Anglo-American thinkers such as Richard Rorty, Stanley Cavell, John McDowell, and Robert Pippin—he illuminates Adorno’s important revisions to this fraught concept and how his different understanding of autonomous agency, fully articulated, might open up new and positive social and political possibilities. Karl Barth and Martin Heidegger are doubtless two of the most important and influential thinkers of the 20th century. In this groundbreaking book Timothy Stanley investigates how the question of being developed through their respective accounts of protestant theology. Whereas Heidegger suggested a post-onto-theological pathway, Barth inverted the question of being in a thoroughgoing theological ontology. In the end, both reconfigured the relationship between philosophy and theology in ways that continue to shape contemporary debate.

Even though it’s frequently asserted that we are living in a golden age of scripted television, television as a medium is still not taken seriously as an artistic art form, nor has the stigma of television as “chewing gum for the mind” really disappeared. -/- Philosopher Martin Shuster argues that television is the modern art form, full of promise and urgency, and in New Television, he offers a strong philosophical justification for its importance. Through careful analysis of shows including (...) The Wire, Justified, and Weeds, among others; and European and Anglophone philosophers, such as Stanley Cavell, Hannah Arendt, Martin Heidegger, and John Rawls; Shuster reveals how various contemporary television series engage deeply with aesthetic and philosophical issues in modernism and modernity. What unifies the aesthetic and philosophical ambitions of new television is a commitment to portraying and exploring the family as the last site of political possibility in a world otherwise bereft of any other sources of traditional authority; consequently, at the heart of new television are profound political stakes. This paper approaches the question of awareness outside of attention through a broader psychological examination of human consciousness. Questions regarding the boundaries of conscious awareness, as well as the possibility of 'subconscious' or 'unconscious' mental processes, were widely discussed 100 years and more ago when they played a central role in the thinking of turn-of-thecentury theorists such as William James, F.W.H. Myers, Jean-Martin Charcot, and Pierre Janet, all of whom were interested in dissociative phenomena suggestive of consciousness, or awareness, (...) beyond the margins of attention. Such phenomena included hypnosis, hysteria, trance states, and motor automatisms, and for many scholars also sleep related conditions such as dreaming and hypnogogic states. (shrink)

In a series of important papers, A. Fine has developed and defended the view that the proper reading of scientific practice is neither realist nor antirealist. Instead, he argues that realism and antirealism both add something extra to a core position which is neither. In this discussion I reexamine his claim in the light of some criticisms. In theater studies, the dramatic text tends to be treated as a remnant of an older and even old-fashioned type of theater that has now been replaced by a “post-dramatic” theater, answering only to the logic of performance. Against that view, the article argues for the continuing importance of the dramatic text across different types of theater, including those termed post-dramatic. For what has changed in the case of theater groups such as the Wooster Group that are associated with post-dramatic (...) theater is not that they discard the dramatic text, but rather that they envision a different relation to it. In order to capture the different functions of text in theater, the essay proposes three models and touches on their historical manifestations. The first assumes that the dramatic text dictates theatrical performance; the second, that the dramatic text needs to be supplemented by theatrical performance; and the third, that the text needs to undergo a process of adaptation. This third model is then applied to two case studies, the production by the Wooster Group of Gertrude Stein's Doctor Faustus Lights the Lights and the production by Big Dance Theater of Mac Wellman's Antigone. Friendship, on George Santayana’s account, is a form of human society made possible by consciousness of ideals while simultaneously rooted in the experience of embodied creatures spontaneously drawn to each other. His philosophical and autobiographical writings on friendship (particularly his friendship with Frank Russell) exemplify a practice of cultivating wisdom and suggest how we can come to understand our own actual friendships and the opportunities for self-knowledge and sanity in them.

One of a pair ofbooks selected from Stanley Rosen's career as a philosopher, scholar, and teacher over the last half of a century. They represent both the vast range of his learning in the most important philosophers of the tradition and the daring and penetration of his exploration of the fundamental philosophical questions. Yet the essays are written with an accessibility that is an expression of Rosen's thesis that our ordinary experience and speech provides the only stable ground for (...) understanding and evaluating extraordinary thought and experiences. Rosen proposes that only a qualified Platonism in which the preservation of the link between the good and the rational on the everyday level was preserved on the philosophical level, can do justice to our experience of ourselves. The notions of form and intuition play a central role in his proposal to preserve the spontaneity of the soul and the heterogeneity of its objects. The essays were originally written for a variety of purposes: there are panoramic reviews of his philosophical intentions, intricate analyses of fundamental problems, challenging interpretations of classical texts, reviews of other authors, and informal commentaries on the state of philosophy in our time. Taken together these essays provide a key to the some of the most decisive questions in philosophy and a valuable explication of some the central themes of Rosen's work. The essays were selected from articles, chapters, and unpublished lectures that were composed over the last five decades. They are distributed into two volumes by their focus upon ancient and modern themes, a convenient division that is not meant to imply a doctrinal chasm. On the contrary, it is one of Rosen's arguments that those who wish to preserve ancient wisdom are best served by the demonstration of the both parties address the same essential human nature, however much the practical and theoretical demands differ from epoch to epoch. Many have been struck by Hannah Arendt’s remarks on loneliness in the concluding pages of The Origins of Totalitarianism, but very few have attempted to deal with the remarks in any systematic way. What is especially striking about this state of affairs is that the remarks are crucial to the account contained therein, as they betray a view of agency that undergirds the rest of the account. This article develops Arendt’s thinking on loneliness throughout her corpus, showing how loneliness is (...) connected to thoughtlessness. In so doing, the article also suggests a connection between Arendt’s notion of loneliness and Stanley Cavell’s notion of skepticism. This connection, it is argued, allows us not only fully to answer a question Arendt leaves unaddressed (the cause loneliness), but also allows us to see how we, as agents and users of language, are perpetually prone to loneliness. Er bezieht sich zum einen auf Cavells an Thoreau und Emerson orientierte dynamische Konzeption des Selbst, das sich erst in ständiger Auseinandersetzung bildet und weiterentwickelt. Er steht zum anderen für das Bild einer intern agonal verfassten Gemeinschaft, die sich nie mit dem erreichten Maß an Gerechtigkeit zufrieden gibt.

Those of us who are captivated by new television, often find ourselves rewatching episodes or whole series. Why? What is the philosophical significance of the phenomenon of rewatching? In what follows, I engage with the ontology of television series in order to think about these questions around rewatching. I conclude by reflecting on what the entire discussion might suggest about the medium of new television, about ourselves, and also about our world and the possibilities of art in it.

When it comes to how Heidegger understands theology, Martin Luther was instrumental in his early formulations. Heidegger's interpretation of Luther leads him to descry theology as a discipline best left unfettered by metaphysics and this attitude is carried right through Heidegger's career. By explicating Luther's influence upon Heidegger's early Freiburg lectures from 1919-1923, we can raise important questions about the nuanced way Heidegger construes Luther's theology in the hopes of inspiring key insights for Luther's appropriation in current post-Heideggerian philosophical (...) theology. This book provides a novel reevaluation of Jacques Derrida’s deconstructive account of writing. Derrida’s various essays on writing's materiality in books, scrolls, typewriters and digital displays, briefly touched on the question of religion. At times he directed his attention to the mediatic nature of Christianity. However, such comments have rarely been applied to formal aspects of religious texts. In response, this book investigates the rise of the Christian codex in its second-to-fifth-century-CE Jewish and Greco-Roman contexts. By better understanding the religious (...) nature of this technical development, it becomes possible to reframe writing's coincidence with faith. (shrink)

In this paper, we aim to show that a study of Gilbert Ryle’s work has much to contribute to the current debate between intellectualism and anti-intellectualism with respect to skill and know-how. According to Ryle, knowing how and skill are distinctive from and do not reduce to knowing that. What is often overlooked is that for Ryle this point is connected to the idea that the distinction between skill and mere habit is a category distinction, or a distinction in form. (...) Criticizing the reading of Ryle presented by Jason Stanley, we argue that once the formal nature of Ryle’s investigation is recognized it becomes clear that his dispositional account is not an instance of reductionist behaviorism, and that his regress argument has a broader target than Stanley appears to recognize. I argue that Theodor W. Adorno is best understood as a moral perfectionist thinker in the stripe of Stanley Cavell. This is significant because Adorno’s moral philosophy has not received serious interest from moral philosophers, and much of this has to do with difficulties in situating his thought. I argue that once Adorno is situated in this way, then, like Cavell, he offers an interesting moral perspective that will be of value to a variety of moral theorists. My argument (...) proceeds in two broad steps: first, I show that Cavell and Adorno share a distinct epistemological orientation, one that centers around the impossibility of knowledge in certain situations, and trades on a Kantian and post-Kantian picture. It is well known that the American director Terrence Malick studied philosophy under Stanley Cavell and translated the work of Martin Heidegger. He eventually traded Harvard and Oxford for Hollywood, though. This essay traces Malick's evolution from budding academic philosopher to cinematic innovator. It suggests that Malick's cinematic career should be viewed as both a rejection of academic philosophy and a celebration of the examined life.
